APOLLO HOSPITALS ENTERPRISE LIMITED, including its affiliates (hereinafter referred to as "Company", "we", "us", "our" and terms of similar meaning), recognises the importance of maintaining the privacy of the information belonging to you. This Privacy Policy sets out details of how we treat user information we collect on each of the platforms that are owned, controlled and operated by us, including our website www.onco.com (the "Website"), email communications sent/received by us and text messages sent/received by us, and domain name, and any other linked pages, features, content, or any other services we offer from time to time in connection therewith (collectively, the "Platform"). The Platform proposes to provide a platform for discovering, booking, and managing oncology-related healthcare services. ("Services").

This website is published and maintained by the Company. This Privacy Policy, as amended from time to time ("Privacy Policy") is applicable to the websites of the Company. The Privacy Policy forms part and parcel of the terms-and-conditions ("Terms") and is included therein by this reference. This Privacy Policy does not apply to the websites of our business partners, corporate affiliates or to any other third parties, even if their websites are linked to the site. We recommend you review the respective privacy statements of the other parties with whom you interact.
The capitalized terms which have been used herein but are not specifically defined shall have the same meaning as attributed to such term in the Terms. In the event of any inconsistency between the Terms and this Privacy Policy, the Privacy Policy will supersede solely in respect of the content contained herein and not in respect of any other clause, term or provision contained in the Terms.

By visiting and/or using the Platform, you (hereinafter referred to as "You", "Your", "User", as applicable) agree and explicitly consent to Our collection, storage, use and disclosure of the Personal Information (as defined hereunder) in accordance with the terms of this Privacy Policy and it shall be deemed that you have read in full, accepted and agreed to the terms herein, including any changes that we may make from time to time. You unconditionally signify Your (i) assent to the "Privacy Policy", and (ii) consent to the utilization of your Personal Information in accordance with the provisions of this "Privacy Policy". The Company reserves the right to modify the terms contained in this Privacy Policy at any time by posting such modification on the Website. The modified Privacy Policy would be effective from the date of modification that is posted by the Company on the Website. If you do not agree to any term that is contained in this Privacy Policy, please immediately cease your use of the Platform.

Information that is collected by the Company on the Platform shall be used by the Company only for the purpose of providing the Services (as defined hereinafter), and such information shall not be used, sold, transferred or rented in a manner that is not set out in this Privacy Policy.

1. REGISTERED USERS

1.1.

Minors (as defined under the laws of their jurisdiction or residence) are not eligible to register for or use the Services available on Our Platform. We do not knowingly collect Personal Information from any minor and we will not use this information if We discover that it has been provided by a minor. If you have reason to believe that a minor has provided Personal Information (as defined below) to Us through the usage of Our Platform, please contact Us at help@onco.com and we will endeavour to delete that information and terminate the minor's account from our databases.

You acknowledge that You are providing Your Information out of Your free will. If You use the Services on behalf of someone else (including but not limited to, Your child – minor or major or as a legal representative of an individual with mental illness), You represent that You are authorized by such individual to (i) accept this Privacy Policy on such individual's behalf, and (ii) consent on behalf of such individual to Our collection, use and disclosure of such individual's Personal Information as described in this Privacy Policy.

2. Information that is collected by the company

Our primary goal is to provide You a safe, efficient, smooth and customized experience. This allows Us to provide Services and features that most likely meet Your needs, and to customize the Platform to make Your experience safer and easier. More importantly, while doing so, We collect Personal Information, non-personal information and other information and correspondences from You, as detailed below, that We consider necessary for achieving this purpose (such information and correspondences hereinafter collectively referred to as "Information"). (ii)Birth date/age,
(iii)Blood group,
(iv)Gender,
(v)Address (including country and pin/postal code),
(vi)Location information, including Your GPS location,
(vii)Phone number/mobile number,
(viii)Email address,
(ix)Physical, physiological and mental health condition, provided by You and/or Your healthcare service provider or accessible from Your medical records,
(x)Personal medical records and history,
(xi)Reports, prescriptions, consultation books, etc;
(xii)Valid financial information (such as bank account details or credit card numbers) at time of availing the Services and/or online payment,
(xiii)Login ID and password,
(xiv)User details as provided at the time of registration or thereafter,
(xv)Records of interaction with Our representatives,
(xvi)Your usage details such as time, frequency, duration and pattern of use, features used, and the amount of storage used,
(xvii)Master and transaction data and other data stored in Your user account,
(xviii)Browser language, referring URL, files accessed, errors generated, time zone, operating system and other visitor details collected in Our log files, and other statistics,
(xix)User's tracking Information such as, but not limited to the device ID, Google Advertising ID and Android ID,

Note: Any content on the Platform shared by You or end users via reviews, blogs, feedbacks, online chat or instant messages, discussion boards, forums, user testimonials etc. are not considered as Personal Information and is not subject to the terms of this Privacy Policy. We will not be responsible for the accuracy or filtration of any of the content posted on Our Platform by You or any end user, however, We will be entitled to remove any content posted by any person on Our Platform which We, in Our sole discretion, consider offensive, discriminatory, racist, defamatory or inappropriate in nature.

When browsing our Platform, you are not required to provide any Personal Information unless and until you choose to obtain our Services as available on the Platform. You may, however, visit our Platform anonymously.

3. INFORMATION MAY BE COLLECTED IN SEVERAL WAYS

Active collection:

This refers to the Information that is actively provided by you while registering on the Platform, while availing of the Services through the Platform, while making payments using the payment gateway on the Platform etc.

3.2.
Passive collection:

This refers to the Information that is gathered by the Company using tracking tools like Google Analytics, Google Webmaster, browser cookies etc. for collecting information about your usage of our Platform. This information may be used by the Company for internal research to understand User demographics, interests and behaviour with a view to improving the functionality of the Platform, track your preferences, to provide you with a customized Platform experience, to notify you of any updated information and new services and other related functions offered by the Platform/ Company, keep you informed about latest content available on the Platform, special offers, and other products and services of the Company, to assist you with customer service or technical support issues and so on.

We may process the Information you provide in any one or more of the following manners, in accordance with this Privacy Policy and as permitted by applicable laws collectively referred to as "Purpose(s)":

You accept, acknowledge and agree that the Company shall be entitled to process the Information in accordance with this Privacy Policy and as permitted by the applicable law;

5. SHARING OF INFORMATION BY THE COMPANY WITH THIRD-PARTIES

You provide Your explicit consent in respect of the following events:

5.1.
Service Providers:

The Company shall share your information with third parties who the Company has contracted with for assistance with performing the Services such as doctors, hospitals, the medical board constituted by the Company, payment processors or transactional message processors. In the future, your medical data and history in a deidentified form may be shared with researchers for study, analysis and publication.

5.2.
Compliance with law:

The Company might share your information to respond to a court order or subpoena. The Company may share your information if a government agency or investigatory body requests the Company to do so.

5.3.

In the event of an audit, reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings), we may share/transfer/assign the Information we have collected to the relevant third party.

5.4.

We may also release Your information when We believe release is appropriate to comply with the applicable laws, enforce Our Platform policies, or protect Ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses. We may disclose Information, in good faith, wherein the access, use, preservation or disclosure of such Information, including preservation of transaction history is reasonably necessary to (i) satisfy any applicable law, regulation, legal process or enforceable governmental request; (ii) enforce applicable Terms, including investigation of potential violations thereof; (iii) detect, prevent, or otherwise address fraud, security or technical issues; (iv) protect against imminent harm to our rights, property or safety, our users or the public as required or permitted by law; or (v) to defend against legal claims; special circumstances such as compliance with subpoenas, court orders, requests/order from legal authorities or law enforcement agencies requiring such disclosure.

6. DATA RETENTION

We shall be entitled to retain Your Information for Our record for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law and such Information shall be used by Us only in consonance with this Privacy Policy. The criteria for determining the duration for which We will keep Your Personal Information are as follows:

6.1.We will retain copies of Your Personal Information in a form that permits identification only for as long as is necessary in connection with the purposes set out in this Privacy Policy, including for the length of time We have an ongoing relationship with You and provide the Platform to You;
6.2.if there is a legal obligation to which We are subject (for example, certain laws require Us to keep records of Your transactions for a certain period of time before We can delete them); or
6.3.keeping in view the legitimate interests of the Company (litigation or regulatory investigations).

7. ACCESSING AND UPDATING YOUR INFORMATION

7.1.

As a User of the Platform, You can update or modify the Personal Information you have included in your profile or change your username by logging in and accessing Your account. If You wish to delete Your account, upon your request, the Company will use commercially reasonable efforts to delete your account within 7 (seven) days of receipt of such request; however, it may be impossible to remove your account without some residual information being retained by the Platform in accordance with this Privacy Policy. Further, You understand, acknowledge, agree and accept that We may store a copy of Your Information to be in compliance with applicable laws and We will not be obligated to delete such Information.

8. SECURITY OF YOUR INFORMATION

8.1.

Please note that neither the Company nor any of its representatives would have access to the password that relates to your User account on the Platform. You shall be solely responsible for protecting your login credentials to the Platform, and the Company shall not be liable in any manner for unauthorised use of your login credentials. You shall be liable to the Company for any loss suffered by the Company as a result of unauthorised use of your login credentials. 8.2.

The security of Your Personal Information is important to Us. While the Company shall seek to implement the best market practices and security policies for the protection of your Personal Information, it shall not be liable for improper use or disclosure, unauthorised modification and unlawful destruction or accidental loss of Information. It is expressly stated that the Company shall not be responsible for any actions of any third parties that receive Users' Personal Information or events that are beyond the reasonable control of the Company including without limitation, acts of government, computer hacking, unauthorized access to computer data and storage devices and storage technology, hardware, computer crashes, breach of security and encryption etc.

8.3.

You acknowledge that neither the Company nor any of its directors, shareholders or other representatives shall be liable to You under any circumstances for any direct, indirect, punitive, incidental, special or consequential damages that result from or arise out of, or a breach or, or compromise of registration of Your User Account with us, You loss of Your user id and password in respect of Your User Account and/or Your ability or inability to use the User Account.

8.4.
Cookies:

A cookie is a small file which asks permission to be placed on your computer's hard drive. Once you grant the permission, the file is added, and the cookie helps analyze web traffic or lets you know when you visit a particular site. The Company uses cookies to personalize Your experience on the Platform and to display advertisements or send you emails of offers of Your interest (provided you have not opted out of receiving such emails). The Company also uses traffic log cookies to identify which pages are being used. This helps the Company analyze data about web page traffic and improve the functioning of the Platform. This information is used by the Company only for statistical analysis and then the data is removed from the system. 9. THIRD PARTY SITES

9.1.

If you click on one of the links to third party websites that may be available on the Platform, you may be taken to websites that the Company does not control. This Privacy Policy does not apply to the privacy practices of those websites. If You can't find the privacy policy of any of these third party sites, You should contact the relevant third party site directly for more information.

9.2.

The Company shall not be liable for the misuse of your Personal Information by third party websites. We do not provide any Personal Information or personally identifiable information to third party websites/ advertisers/ad-servers without Your consent.

10. YOUR CONSENT

10.1.

By using the Platform and/or by providing Your Information, You consent to the collection and use of such Information in accordance with this Privacy Policy, including but not limited to Your consent for sharing Your Information as per this Privacy Policy. You specifically agree and consent to us collecting, storing, processing, transferring and sharing Information (including Personal Information) related to You with third parties, service professionals or to registered vendors/users for the purposes as set out in this Privacy Policy.

10.2.

You may withdraw Your consent to submit any or all Personal Information or decline to provide any permissions on its Platform as covered above at any time. In case, You choose to do so then Your access to the Platform may be limited, or We might not be able to provide the Services to You. 11. REDRESSAL OF GRIEVANCES

11.1.

If a User has any questions or grievances regarding the Platform, the contents thereof, the manner in which Personal Information is being collated or processed by the Platform or regarding the Services, the User may reach out to The Grievance Officer of the Company --Mr. Pawan Dutta pawan_datta@apollohospitals.com. The Grievance Officer shall address any complaint or grievance that is raised by a User within a reasonable time from when it is raised.

11.2.

Where the Company requires additional information to process and respond to the query raised by a User, the Company shall notify the User of the same and the User shall provide all such information and assistance.

12. MISCELLANEOUS PROVISIONS

12.1.
Force Majeure:

The Company shall not be responsible for any cessation, interruption or delay in the performance of its obligations hereunder due to earthquake, flood, fire, storm, natural disaster, act of God, war, terrorism, armed conflict, labor strike, lockout, or boycott or such other events beyond the reasonable control of the Company. The Company may at any time, in its sole discretion and without advance notice to you, cease operation of the Platform and the provision of the Services.

12.2.
No Waiver:

A delay or failure by the Company to exercise or enforce any right or provision of this Privacy Policy will not constitute a waiver of such right or provision.

12.3.
Notices:

All notices given by a User to the Company shall be in writing and in the English language, at help@onco.com.

12.4.
Governing Law; Jurisdiction:

This Privacy Policy is governed by the provisions of Indian law and Courts in Chennai, India shall have exclusive jurisdiction.
